Health investigators who are looking into the Yorkville Endoscopy Clinic in New York City where Joan Rivers suffered a fatal complication while receiving treatment have found several errors in their procedure and process.

Reports indicated that Rivers suffered severe health problems including brain damage due to several mistakes by the clinic’s staff including her personal physician.

The report by the Centers for Medicare & Medicaid Services (CMS) indicated that the clinic failed to identify deteriorating vital signs and provide timely intervention, failure to administer Propofol correctly by not weighing her prior to administration of the medication, as well as failure to properly and consistently document the dosage of Propofol administered.

The clinic was also faulted for, “failing to ensure she was cared for only be physicians granted privilege in accordance with the clinic’s bylaws.”

There was also controversy about a “selfie” taken of the physician and a sedated Rivers which the report also claims does not adhere to the clinic’s own cell phone policy.

Yorkville Endoscopy Clinic responded to the report in a released statement, “In response to the statement of deficiencies, Yorkville immediately submitted and implemented a plan of correction that addressed all issues raised. The regulatory agencies are currently reviewing the corrective plan of action and have been in regular contact with Yorkville. In addition, the physicians involved in the direct care and treatment referenced in the report no longer practice or provide services at Yorkville.”

Joan’s daughter Melissa initiated the investigation believing her mother’s death could have been avoided, her lawyers also issued a statement.

“Our client, Melissa Rivers, is terribly disappointed to learn of the multiple failings on the part of medical personnel and teh clinic as evidenced by the CMS report. As any of us would be, Ms. Rivers is outraged by the misconduct and mismanagement now shown to have occurred before, during and after the procedure.”

Rivers’ cause of death was classified as a “predictable complication” after lack of oxygen caused brain damage during a procedure in late August, she was then rushed to Mount Sinai Hospital where she was put on life support but the legendary comedienne died a week later on September 4 at the age of 81.
