Kristin Cavallari And Jay Cutler Fight Over Marital Estate Funds Amid Separation

Kristin Cavallari and Jay Cutler’s separation is already getting ugly!

According to new court documents obtained by Entertainment Tonight, which Cavallari filed on Wednesday, April 29, the reality star claimed that Cutler was trying to control their marital assets and prevented her from buying her own home.

The Hills alum – who first announced their separation in a post on Instagram – claimed in the documents that she and her estranged husband “have been experiencing problems in their marriage for the last several years,” and last fall, “Things were so bad in the marriage that [she] started looking for another home.”

According to the documents, after Cavallari found a home she liked, she “put a contract on the property, escrowed the funds,” and her husband “never objected.” However, Cavallari said she decided not to buy the house after she and Cutler “attempted to salvage the marriage.”

“However, both parties realized the attempt to reconcile was not working and knew [separation] was inevitable,” the document read. This March, the couple “started discussions between themselves about how they would divide their assets and exercise parenting time” of their three children – sons Camden and Jaxon, and daughter Saylor.

Since April 7, the estranged couple have been “operating under a nesting agreement for parenting time where each party exercises three days with the children” at their home, according to documents. During Cavallari’s time with their children, Cutler stays with a friend, and vice versa.

Since realizing their marriage was not going to work, Cavallari resumed the home-buying process while Cutler refused to leave the “marital home.”

However, Cavallari claimed that Cutler approached her with a settlement that she felt was “unfavorable” and alleged that he then told her he was going to ask his attorney to tell their business manager not to release the funds she needed to buy herself a new home. Cavallari further claimed that Cutler said he’d only release the funds if she agreed to his parenting and custody plan.

The reality star’s documents state that she “did not learn that [Cutler] had filed the divorce complaint until April 24, 2020, after she informed him that she was planning on signing a contract to purchase the house.” Also, she believes that Cutler “hurried to file his complaint as a way of punishing her.”

But as the documents outline, “Wife does not believe that it is in the best interest of either party or their minor children to reside in the same household… Wife fears that if the parties are required to remain in the same residence, it would be an unhealthy environment, causing irreparable harm to their minor children.”

Cavallari argued that she is “is not attempting to infringe on [her] husband’s financial assets to purchase the home, she is simply asking the Court to make a partial distribution to her so that she may purchase another residence.”

In conclusion, Kristin requests the judge allows her to use “her portion of their funds” to purchase the new home.

On Cavallari’s part, her biggest concern regards the emotional well-being of their children, and she’s afraid that if she and Cutler are required to reside in the same home together, it might create “an unhealthy environment causing irreparable harm” to their children.

She claimed that Cutler often “attempts to draw her into an argument” in front of their children and she “fears the situation will escalate.”

Cutler filed for separation on April 21, citing “irreconcilable differences.” Cavallari filed on April 24, citing “marital misconduct” and “irreconcilable differences” as the reason for their split.

Cavallari claimed in her separation documents that Cutler “is guilty of such inappropriate marital conduct as renders further cohabitation unsafe and improper.” The reality star also requested primary custody of their children.
